The Community wishes a relaxation of European standards on its territory, to take into account the economic specificities of Saint-Martin
In continuation of the questions raised within the 24th Conference of Presidents of the ORs, which took place in Saint-Martin from February 5 to 8, the Collectivity of Saint-Martin consulted representatives of the 3 main sectors in recent weeks in order to evaluate with them the needs or avenues in terms of exemption to certain European standards conditioned by our OR status.
Indeed, article 349 of the Treaty on the Functioning of the European Union (TFEU) allows the adoption of measures derogations and adaptation to our specificities, all the more so since the advent of favorable case law (the “Mayotte” judgment of the CJEU thus recognized and clarified the right of the ORs to deviate from European regulations on a certain number of subjects and for a substantial period).
In a letter addressed to the main local professional associations, President Daniel Gibbs recalled the ambition of the Community and its elected to see a stricto sensu application of the provisions of Article 349 of the TFEU, "so that they are fully and faithfully implemented".
Within the Community, the Delegation to Economic Development has been designated as pilot of the work which will be carried out with the representation of socio-professionals of Saint-Martin.
A first progress report aimed at listing and quantifying the most significant grievances will soon be presented to the President Daniel Gibbs and Vice-President of the Economic Development Delegation Yawo Nyuiadzi.
